§ 1

This Act shall have as its purpose to ensure that persons unlawfully deprived of liberty are freed from unlawful custody in speedy, simple judicial proceedings, in accordance with the Japanese Constitution's stated purpose of protecting fundamental human rights.

第一条

 この法律は、基本的人権を保障する日本国憲法の精神に従い、国民をして、現に、不当奪われている人身の自由を、司法裁判により、迅速、且つ、容易に回復せしめることを目的とする。

§ 2

Persons held in custody in violation of due process of law may obtain relief pursuant to this Act.

第二条


法律上正当な手続によらないで、身体の自由を拘束されている者は、この法律の定めるところにより、その救済請求することができる。

Any person may file a petition for relief pursuant to paragraph 1 of this section on behalf of a prisoner.


何人も被拘束者のために、前項の請求をすることができる。

§ 3

A petition filed pursuant to § 2 may only be filed by and through an attorney. However, if extraordinary circumstances require, the petition may be filed by the petitioner acting pro se .

第三条

 前条の請求は、弁護士を代理人として、これをしなければならない。但し、特別の事情がある場合には、請求者がみずからすることを妨げない。

§4

A petition pursuant to § 2 may be made orally or in writing at the Superior Court or District Court having jurisdiction over the prisoner, the custodian, or the petitioner.

第四条

 第二条の請求は、書面又は口頭をもつて、被拘束者、拘束者又は請求者の所在地を管轄する高等裁判所若しくは地方裁判所に、これをすることができる。

§5

The petition shall allege the following, and include documentation:

 請求には、左の条項を明らかにし、且つ、疏明資料を提供しなければならない。

§6

The Court shall decide the petition in a timely fashion.

第六条

裁判所は、第二条の請求については、速かに裁判しなければならない。

§7

If the petition does not meet the requirements of § 5 or does not include documentation, the Court may enter an order denying the petition.

第七条

 裁判所は、請求がその要件又は必要な疏明を欠いているときは、決定をもつてこれを却下することができる

§8

Upon the filing of a petition pursuant to § 2, the Court, upon the motion of the petitioner or sua sponte, may transfer the matter to any other court having jurisdiction if the Court deems such transfer to be proper.

第八条

 第二条の請求を受けた裁判所は、請求者の申立に因り又は職権をもつて、適当と認める他の管轄裁判所に、事件移送することができる。

§9

Except as provided in § 2, the Court shall timely hear the testimony of the custodian, the prisoner, the petitioner, the petitioner's counsel, and any other party to the matter in preparation for the evidentiary hearing, and may make any other necessary inquiries into the reasons for which the prisoner is being held in custody, as well as other matters.

第九条


 裁判所は、前二条の場合を除く外審問期日における取調の準備のために、直ちに拘束者、被拘束者、請求者及びその代理人その他事件関係者の陳述を聴いて、拘束の事由その他の事項について、必要な調査をすることができる。

The inquiry provided for in paragraph 1 of this section may be carried out by a member of a division of the Court.


前項の準備調査は、合議体構成員をしてこれをさせることができる。

§10

If the Court deems it necessary, before entering a decision pursuant to § 16, the Court may enter an order releasing the prisoner pending final determination of the merits of the petition on the condition that the prisoner take an oath to appear before the Court at any time the Court so orders, or on any other conditions the Court deems proper, and may take any other action it deems appropriate.

第十条


 裁判所は、必要があると認めるときは、第十六条の判決をする前に、決定をもつて、仮りに、被拘束者を拘束から免れしめるために、何時でも呼出しに応じて出頭することを誓約させ又は適当と認める条件を附して、被拘束者を釈放し、その他適当な処分をすることができる。

If prisoner released pursuant to paragraph 1 of this section fails to appear when so ordered by the Court, the Court may order that the prisoner be detained.


前項の被拘束者が呼出に応じて出頭しないときは、勾引することができる。

§11

If, upon completion of the preliminary inquiry, it appears that the petition is clearly without merit, the Court may enter an order dismissing the petition without holding a hearing.

第十一条


 準備調査の結果、請求の理由のないことが明白なときは、裁判所は審問手続を経ずに、決定をもつて請求を棄却する。

If the Court enters an order pursuant to paragraph 1 of this section, any order entered pursuant to § 10 shall be vacated, and the prisoner shall be ordered to appear before the Court to be taken into custody by the custodian.


 前項の決定をなす場合には、裁判所は、さきになした前条の処分を取消し、且つ、被拘束者に出頭を命じ、これを拘束者に引渡す

§12

Except as provided in § 7 or § 11, the Court shall set a date and location for a hearing, and shall serve the petitioner, petitioner's counsel, the prisoner, and the custodian with notice to appear.

第十二条

 第七条又は前条第一項の場合を除く外、裁判所は一定の日時及び場所を指定し、審問のために請求者又はその代理人、被拘束者及び拘束者を召喚する。

The Court shall order the custodian to present the prisoner on the date and at the location set pursuant to paragraph 1, and to file a return to the petition, in which the custodian shall set forth the date, location, and cause of the prisoner's incarceration.


 拘束者に対しては、被拘束者を前項指定の日時、場所に出頭させることを命ずると共に、前項の審問期日までに拘束の日時、場所及びその事由について、答弁書提出することを命ずる。

An order pursuant to paragraph 2 shall inform the custodian of the possibility of imprisonment for failure to comply with such order and of a fine not to exceed five hundred yen for each day such noncompliance continues.


 前項の命令書には、拘束者が命令に従わないときは、勾引し又は命令に従うまで勾留することがある旨及び遅延一日について、五百円以下の過料に処することがある旨を附記する。

There shall be a period of three days between the service of the order and the date of the hearing. The date of the hearing shall be no more than one week from the date on which the petition was filed pursuant to § 2. However, this period may be extended or shortened if special circumstances make such extension or shortening necessary.


 命令書の送達と審問期日との間には、三日の期間をおかなければならない。審問期日は、第二条の請求があつた日から一週間以内に、これを開かなければならない。但し、特別の事情があるときは、期間は各々これを短縮又は伸長することができる。

§13

An order pursuant to § 12 shall be served upon the court and prosecutor who ordered the prisoner's imprisonment.

第十三条


 前条の命令は、拘束に関する令状を発した裁判所及び検察官に、これを通告しなければならない。

The court and prosecutor referred to in paragraph 1 may be present at the hearing.


前項の裁判所の裁判官及び検察官は、審問期日に立会うことができる。

§14

1 All fact-finding at the hearing shall be carried out in open court in the presence of the prisoner, the custodian, the petitioner, and their representatives.

第十四条


 審問期日における取調は、被拘束者、拘束者、請求者及びその代理人の出席する公開の法廷において、これを行う。

If the petitioner or the prisoner is not represented by counsel, the court shall appoint a practising attorney to represent him.


 代理人のないときは、裁判所は弁護士の中から、これを選任せねばならない。

A legal representative within the meaning of 2 may request reimbursement for travel costs, a daily allowance, lodging costs, and reasonable attorney's fees.


前項の代理人は、旅費日当宿泊料及び報酬を請求することができる。

§15

1
At the hearing, the Court shall hear the statements in support of the petitioner's petition and the custodian's return, and examine the documentation in support of the petition.

第十五条


 審問期日においては、請求者の陳述及び拘束者の答弁を聴いた上、疏明資料の取調を行う。

The custodian shall provide documentation in support of the alleged cause for imprisonment.


拘束者は、拘束の事由を疏明しなければならない。

§ 16

Based on the hearing, if the Court finds the petition to be unsupported, the Court shall deny the petition and remand the prisoner to the custody of the custodian.

第十六条


 裁判所は審問の結果、請求を理由なしとするときは、判決をもつてこれを棄却し、被拘束者を拘束者に引渡す。

In cases to which paragraph 1 applies, the provisions of § 14(2) shall apply accordingly.


前項の場合においては、第十一条第二項の規定を準用する

If the Court finds the petition to be well-founded, the prisoner shall be released immediately by order of the Court.


請求を理由ありとするときは、判決をもつて被拘束者を直ちに釈放する。

§17

In proceedings pursuant to §§ 7, 11(1), and 16, the custodian or the petitioner may be ordered to pay all or part of the costs of the proceedings.

第十七条

 第七条、第十一条第一項及び前条の裁判において、拘束者又は請求者に対して、手続に要した費用の全部又は一部を負担させることができる。

§18

If the custodian fails to comply with an order pursuant to § 12(2), the Court may order the arrest of the custodian or require the custodian to pay a fine not to exceed five hundred yen for each day of noncompliance.

第十八条

 裁判所は、拘束者が第十二条第二項の命令に従わないときは、これを勾引し又は命令に従うまで勾留すること並びに遅延一日について、五百円以下の割合をもつて過料に処することができる。

§19

If the prisoner requests appointment of counsel, the custodian shall inform the lawyer of the prisoner's choosing of such request in a timely manner.

第十九条

 被拘束者から弁護士を依頼する旨の申出があつたときは、拘束者は遅滞なくその旨を、被拘束者の指定する弁護士に通知しなければならない。

§20

The Court, after receiving a petition pursuant to § 2, or having received a transferred petition, shall immediately inform the Supreme Court, and report to the Supreme Court on all actions taken in regard to such petition and the results of the proceedings.

第二十条

 第二条の請求を受けた裁判所又は移送を受けた裁判所は、直ちに事件を最高裁判所に通知し、且つ事件処理の経過並びに結果を同裁判所に報告しなければならない。

§21

The decision of a lower court may be appealed to the Supreme Court within three days of the issuance of the decision.

第二十一条

 下級裁判所の判決に対しては、三日内に最高裁判所に上訴することができる。

§22

If the Supreme Court finds it necessary, it may sua sponte transfer a case currently pending before a lower court, at any stage of the proceedings, and dispose of the matter itself.

第二十二条


 最高裁判所は、特に必要があると認めるときは、下級裁判所に係属する事件が、如何なる程度にあるを問わず、これを送致せしめて、みずから処理することができる。

In the cases to which paragraph 1 is applicable, the Supreme Court may vacate or modify the proceedings or disposition of the lower court.


 前項の場合において、最高裁判所は下級裁判所のなした裁判及び処分を取消し又は変更することができる。

§23

The Supreme Court may enact such rules as it deems necessary concerning petitions, hearings, proceedings, and any other relevant matter.

第二十三条

 最高裁判所は、請求、審問、裁判その他の事項について、必要な規則を定めることができる

§24

If proceedings carried out pursuant to another law are unfavourable to the prisoner, such proceedings shall be void to the extent that they are inconsistent with this Act.

第二十四条

 他の法律によつてなされた裁判であつて、被拘束者に不利なものは、この法律に基く裁判と牴触する範囲において、その効力失う

§25

A person who has been granted relief pursuant to this Act may not be again imprisoned for the same cause as the imprisonment from which the proceedings pursuant to this Act arose except by judgment of a court.

第二十五条

 この法律によつて救済を受けた者は、裁判所の判決によらなければ、同一の事由によつて重ねて拘束されない。

§26

Anyone who moves, conceals, hides, or otherwise commits any act which obstructs the granting of relief pursuant to this Act, or makes false statements in a return filed pursuant to § 26 shall be liable to imprisonment at hard labour not to exceed two years or a fine not to exceed fifty thousand yen.

第二十六条

 被拘束者を移動蔵匿隠避しその他この法律による救済を妨げる行為をした者若しくは第十二条第二項の答弁書に、ことさら虚偽の記載をした者は、二年以下の懲役又は五万円以下の罰金に処する。

Transitional Provision

This Act shall take effect sixty days from the date of its promulgation.

附則

 この法律は、公布の後六十日を経過した日から、これを施行する。
